This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that requires publishing the rules and regulations, privacy policy, and Terms and Conditions for access or usage of the Fasto platform.
The domain name fasto.in (hereinafter referred to as the “Platform”) is owned and operated by Fasto Mobility Private Limited.
For the purpose of these Terms and Conditions:
“Invoice” refers to the billing document generated after a successful booking and payment.
“Platform” means the Fasto website or mobile application through which Services are offered.
“Rental Period” means the time from which the User takes possession of the bike to the time it is returned to Fasto.
“Services” means rental services provided by Fasto, including two-wheeler (bike/scooter) bookings.
“User” means a person who registers and books a bike using the Fasto Platform.
“Vehicle” refers to the bike or scooter rented to the User, including all associated parts and accessories.
Use of the Platform and Services is subject to the following Terms and Conditions, including any additional policies incorporated herein by reference. If the User accesses or uses the Services, these Terms and Conditions shall constitute a binding agreement between the User and Fasto.
1.1. The Services are only available to individuals aged 18 years or older, who can enter into legally binding contracts and possess a valid two-wheeler driving license under applicable laws.
1.2. Persons of unsound mind, minors, undischarged insolvents, or any individual not competent to contract under Indian Contract Act, 1872 are not permitted to use the Platform.
1.3. Fasto reserves the right to cancel or deny access to any User found ineligible, or who has submitted false documentation or information.
2.1. The bike shall be used exclusively by the User and shall not be sub-leased or lent to others.
2.2. The User must present a valid original driving license and photo ID matching the uploaded documents at the time of pick-up, failing which Fasto reserves the right to cancel the booking without refund.
2.3. The User must provide emergency contact details while making the booking.
2.4. The User must inform Fasto of the drop-off location and estimated return time during the booking process.
2.5. Bikes must be returned at the designated return point and within the rental period. Failure to do so may incur additional charges.
2.6. The bike must be returned in clean, working condition with all accessories intact (helmet, mirror, documents, etc.).
2.7. Damages beyond normal wear and tear must be compensated by the User. Repairs must be carried out at authorized service centers with prior approval from Fasto.
2.8. In case of loss/damage to documents, a fine and processing fee will be charged.
2.9. No tampering with the number plate, odometer, or any other part is allowed. Violations may lead to legal action and financial penalties.
2.10. Smoking or consuming alcohol/drugs while using the vehicle is strictly prohibited. Violations will attract penalties and cancellation of the rental.
2.11. Helmets are mandatory while riding. The User is responsible for following traffic rules and ensuring rider safety.
2.12. The User shall bear fuel costs. Vehicles must be returned with the same fuel level as provided, failing which refueling charges will apply.
2.13. Late returns beyond a 30-minute buffer will incur additional hourly rental charges.
2.14. If the bike is returned dirty or in a poor condition, cleaning charges will be levied.
2.15. The User shall not:
Use the bike for commercial purposes (e.g., food delivery) without written permission from Fasto.
Participate in racing or stunts.
Ride under the influence of drugs or alcohol.
Take the bike outside India or into restricted/naxal/riot-prone zones.
Transport hazardous or illegal materials.
2.16. The User must notify Fasto immediately in case of any accident, damage, or theft. The User must also:
File a police report (FIR) if required.
Not admit guilt or offer compensation without Fasto’s consent.
Cooperate fully with insurance or legal investigations.
2.17. The User agrees to protect Fasto’s interests and insurance policies by complying with traffic and insurance regulations.
2.18. A fine of ₹10,000 or more may be imposed for any violation of these Terms or damage to the bike or its documents.
2.19. Fasto reserves the right to adjust such penalties or charges from the security deposit without notice.
3.1. The User agrees to use the Services at their own risk. Fasto disclaims all warranties, express or implied, including but not limited to fitness for a specific purpose, condition, or merchantability of the Vehicle.
3.2. Fasto is not liable for any damages or losses caused by the use of its Services, including any service unavailability due to unforeseen or uncontrollable circumstances.
Fasto reserves the right to modify or update these Terms and Conditions at any time without prior notice. Continued use of the Platform or Services after such changes will be deemed as acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in [City], India.
By using the Platform and availing the Services, the User acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions and Fasto’s Privacy Policy.
